A lasting Power of Attorney is a legal document, which allows you to appoint someone that you trust to make decisions on your behalf. Under a power of Attorney, the Attorney that you appoint will be able to make decisions for you when you no longer wish to or when you are unable to make decisions.


Power of Attorney can help you plan how matters relating to your health, wellbeing and finances will be dealt with. It can be used to help you plan the decisions you want to be made on your behalf if you lose the capacity to make them yourself (in the event of any injury or illness).


Having a lasting Power of Attorney is a safe way of maintaining control over decisions made for you, because whomever you choose as your Attorney will be required to confirm they understand the significance and purpose of being an Attorney for you. Also, Attorneys are required to follow the Code of Practice of the Mental Capacity Act 2005 and a lasting Power of Attorney must be registered with the Office of the Public Guardian before it can be used.
